Welcome to Forget Them Not! These Terms of Service ("Terms") govern your use of our website, products, and services. By accessing or purchasing from forgetthemnot.com (the "Site"), you agree to be bound by these Terms. If you do not agree, please do not use our Site or Services.

1. Overview
Forget Them Not (“we,” “our,” or “us”) provides ready-to-send greeting cards to its customers 2-3 weeks before the recipients birthday - so the occasion is always remembered.

2. Eligibility
To use our services, you must be:

  • At least 18 years old, or have parental/guardian consent;
  • Able to enter into a binding legal agreement;
  • Using the Site in compliance with all applicable laws and regulations.

3. Ordering and Fulfillment

  • All orders are final once placed.
  • Cards will be delivered 2-3 weeks before the recipient's birthdate. 
  • For all orders placed within 3 weeks of a birthdate, we will process your card within 2-3 business days.
  • Delivery timelines may vary due to postal delays beyond our control.
  • Each order includes a greeting card, an envelope, and postage (unless otherwise specified).
  • You’ll choose the cards you want us to send the following year via a QR code link to a survey. If we don't hear back from you before the end of your subscription then we will select gender- and age-neutral cards on your behalf.

4. Pricing & Payment

  • Prices are listed in U.S. Dollars (USD) and include applicable sales tax and shipping unless otherwise stated.
  • We accept payment through secure third-party processors (e.g., Stripe, PayPal).
  • You agree to provide accurate billing information.

5. Returns & Refunds
If your card arrives damaged or you receive the wrong order, contact us at support@forget-them-not.com within 30 days of receipt for resolution.

6. Intellectual Property
All content on this site, including images, text, logos, and designs, are the property of Forget Them Not or its licensors. You may not reproduce, modify, or distribute our content without written permission.

7. Privacy
Your use of the Site is also governed by our Privacy Policy. We collect only the information necessary to fulfill your order and will never sell your data.

8. Prohibited Use
You agree not to use the Site to:

  • Engage in any fraudulent or deceptive activity;
  • Upload or distribute harmful content (viruses, spyware, etc.);
  • Violate the rights of others;
  • Interfere with the functionality of the Site or its services.

9. Limitation of Liability
To the fullest extent permitted by law, Forget Them Not shall not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of profits, data, or goodwill. Our total liability shall not exceed the amount you paid for the specific product.

We may update these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the Site after changes are made constitutes your acceptance of those changes.

11. Governing Law
These Terms are governed by the laws of the State of Vermont, without regard to its conflict of law principles.
